Oracle vs. Google Lawsuit (Android and Java) Research Paper

Oracle vs. Google Lawsuit (Android and Java) - Research Paper Example Google’s Android infringes Oracle America’s copyrights in Java and Google is not licensed to do so. The seven patented technologies in question are: 6,125,447 (Protection Domains To Provide Security in a Computer System); 6, 192,476 (Controlling Access to Resource); 5,966,702 (Method and Apparatus for Preloading of Classes Through Memory Space Cloning of a Master Runtime System Process; RE38,104 (Method And Apparatus For Resolving Data References In Generate Code - A reissued patent; the original number was 5,367,685); 6,910,205 (Interpreting Functions Utilizing A Hybrid Of Virtual And Native Machine Instructions); and, 6,061,520 (Method And System for Performing Static Initialization) (EndSoft Patents 2012). The Java technology was developed by Sun Microsystems now called Oracle America, after its acquisition by Oracle. The deal, valued at $7.4 billion, strengthened Oracle’s objective to out-consolidate its rivals, which was already buoyed by previous acquisitio n of several large companies (Shankland 2010). Because of this, Oracle became a hardware company as well, with an integrated product being pitched to the customers as a combination of hardware and software solution. Android is a Google product, developed in its move to expand in the mobile computing market. It was originally created by Android Inc., which Google bought in 2005. Today, Android is being maintained and developed by the Open Handset Alliance, which is a consortium of 86 hardware, software and telecommunications organizations led by Google. Legal Issues Oracle’s claims of code infringement had been modified in October 2010, which further specified its complaint against Android. In its amended claim filed before the court, Oracle alleged that Google flagship operating system is using or copying Java technologies in its class libraries and documentation, further stressing that approximately one-third of Android’s API packages are â€Å"derivative† of t he Java API packages, including examples of code that aim to prove its point (Lopez-Tarruella, 2012, 279). For Google’s alleged copyright and patent infringement, Oracle originally asked for over $2.4 billion in order to compensate for the damages, which, of course, Google countered as inflated (Latif 2012). Oracle has revised this figure as it amended its complaints several times. Today, it stands at $168 million. Google still think the figures as baseless. In a legal strategy designed to fend off attacks or at least protect its Android ecosystem from lawsuits such as that lodged by Oracle, Google has acquired Motorola Mobility its trove of patented mobile and computing technologies, in addition to the thousands acquired from IBP Patents. The rationale for this move is simple. With a comprehensive range of important mobile and future mobile technologies, Google is in a better position to protect the companies that use Android because it could threaten Oracle with counter lic ense suits. Also, Google could refuse to license technologies to companies such as Microsoft, Nokia and perhaps Oracle if it starts its own mobile computing program in the future. Finally, Google – through its newly acquired patents - could enter into cross-licensing deals with these companies in exchange for dropping the lawsuits or being amenable

Creative Teams and Creative Conflicts Assignment

Creative Teams and Creative Conflicts - Assignment Example In such a situation, Puccio, Mance and Murdock (2011) note that organizational conflicts may be very common. Despite the differences in creative thinking styles, the group could improve their process by following these three principles. In the first place, the group should have talked about their unique differences to create a sense of identity among each other. This is because where there is an understanding of identities it is easier to accommodate other people (Grivas and Puccio, 2012). Secondly, based on the differences in identities, the group should have broken their job down into tasks and assigned compatible thinkers to different jobs. Finally, the group should have had a standby conflict resolution team that would have been responsible for managing all conflicts from the very unset that they showed up. Into the future, it is expected that the process would be approached differently so as to lead to group success. For instance if I was in charge of leadership, I would have used the strategic accommodation skill to ensure that each person appreciated the place of the other person in the collective realization of the organizational goal (Prichard, n.d.). Communications Paper on Media Essay Example | Topics and Well Written Essays - 1000 words

Communications Paper on Media - Essay Example Newspapers also serve a surveillance purpose as they inform about what is going on. Through media, I also satisfy my social and psychological needs. This means media is a powerful tool for transmission of cultures and norms. I am able to be informed and learn about various norms and how I am expected to behave, as well. For instance watching television programs about other cultures makes me aware about them. I am also able to learn about their norms whether it is through print or visual media. Media is also utilized as an advertising tool. Media covers a wide audience making it a powerful tool for advertising and marketing. It is also used to influence the thoughts and needs of the society. Such form of media can be through propaganda whereby information is put out by an organization to promote a particular policy. From all these, the media serve as a gratification tool to the larger society since its survival is on the basis of satisfying the needs of a society (Gibson). 2. Costs sp ent on media Various media exist in our daily lives; therefore, costs are incurred when it comes to accessing media. To access the print media I have to purchase newspapers and magazines some of which are updated daily; thus, it makes sense to acquire them each new day. Print media are extremely important, but more expensive to access; thus, I spend more on it. For instance, to access academic materials, I have to purchase books, which are not easily available via the internet resource. Media is also important because communication and entertainment are a normal part of the day-to-day activities. Visual media are characterized by television and the internet. Costs are incurred in electricity bills and payment of internet subscription fees. When all costs are summed up it can be determined that a lot of money is directed on media in a given month. This can also be summarized by the fact that media consumptions occurs every day. 3. Description of a day without media A day without medi a is quite different since media had evolved to be a habit in my lifestyle. My first instinct in the morning was to check my phone, but I had to ignore the urge. Without media, I would not be in constant touch with others; thus I would not be able to know where I am needed and by whom. I will also find it hard to be informed about new developments around me. Because it felt like an addiction, I could not last a whole day without thinking about what I am missing. For instance, I could not be in contact with my friends and colleagues; thus, I would not be informed about how they are doing or if they have any information related to me. I would also tend to be scared at times because I was not certain about what I am supposed to do during the day. I could not read posters and information posted on notice boards; thus, I was not comfortable. Generally, I felt like I was in my own world since I was not able to access any new information that might influence me. Therefore, from morning to evening I was only making an appearance, but never really involved in anything constructive. By dawn, I felt I had lost a lot of opportunities. 4. What was learned From the experience on that day, I was able to learn and appreciate just how important media is to my daily activities. If I was given such a test, again it would be hard to try it because on that single day, I had missed on a lot. The urge to get information was quite big and I learned that I was

Cities of Salt Essay Example | Topics and Well Written Essays - 750 words

Cities of Salt - Essay Example The historical setting of this novel is crucial in explaining the relationship that existed between tradition and modernity. This novel is set in an Arabian emirate, where western companies are involved in hunting for oil (Munif, 9). This leads into the transition of the people of this emirate from their traditional methods or ways, in to modernity. The author uses this dynamic for purposes of explaining the forces of commoditization and alienation which are depicted to any emerging capitalistic culture. Take for example Miteb al-Hathal, the leader of Wadi al-Uyoun (Munif, 22). This person is confronted by the various changes occurring in his home, and he finds it difficult to use words for purposes of explaining these changes. The silence of Miteb and his disappearance is a representation of the loss that his people are experiencing. It is a symbol of the effects of imposed modernization, and even people who are supportive of it, are unable to use language for purposes of explaining the events and issues that is affecting their lives. A good example that can be used to illustrate this point is Daham al-Muzil (Munif, 25). He is an enthusiastic and loyal worker of Ibn Rashed, an Arabic Speaking individual. He refuses to stop working for Rashed, and learn modern skills that come with technology (Munif, 25). Furthermore, he is unable to speak effectively with the Western workers, who were speaking English. This is a sign that Daham al-Muzil was reluctant to embrace modernity by learning new skills, and working for the new companies that were searching and hunting for oil in the emirates. In this novel, the dramatic change from the Bedouin nomadic culture to modernity, which is represented by Western companies, is problematic. For example, when modernity arrives at Wadi al-Uyoun, the people in this region have been living in a similar manner as their ancestors (Munif, 29). These

Market Efficiency In The Presence of Extermalities Essay

Market Efficiency In The Presence of Extermalities - Essay Example Most positive economists admit the existence of barriers to competition. As such markets are incomplete given the imperfect information relayed to the consumer. Nevertheless, general equilibrium analysis is often utilized to as a theoretical tool to approximate reality. Market efficiency is rather a controversial concept that has attracted strong views, partly in regards to differences about what it really means on one hand, and on the other hand on investor approaches to investing. It is an economic concept that investigates the effects of allocation of scarce resources towards the well-being of the entire participant within a given economy. An efficient market is a market scenario where commodity prices reflect all information available (Fama 383). The degree of efficiency lies in the type if information incorporated into the prices and the speed with which such information are reflective of the market prices (Jensen 96). The question as to whether markets are or are not efficient is central to investment decisions. In a scenario where markets are efficient, commodity price signals provide the best investment appraisal criteria, and the appraisal process itself justifies the market price levels. Under circumstances of inefficient markets, commodities prices deviate from their true values, and the process of investment appraisals utilizes approximate bench marks in obtaining the viability of investment decisions. Valuation under efficient market conditions yields ‘higher’ returns to certain investors, given the capacity to spot mistakes of under-valuing or over-valuing investment decisions (Fama 396). In essence, an efficient market condition is one in which market prices are reflective of true estimates of investment decisions (Jensen 101). Implicitly, and contrary to the popular view, efficiency of markets does not imply that commodities prices prevailing in the market must equal the true value at all time. All that is needed are unbiased commod ities prices, that is to say, prices can randomly deviate from their true value. Under these circumstances therefore, no one group of investors should consistently, with certainty, find their investment strategy running in tandem with market prices. As stated above, the definitions of market efficiency are linked up with information available to investors that are subsequently reflected in commodity prices. Strictly speaking, market efficiency assumes perfect information, for the public and private investors, which is then reflected in the market prices. This implies that investors with precise information on the running of the market will be able to beat the market inefficiencies (Fama 402). Given that the specificity which market efficiency is defined, it is extremely unlikely that markets will be efficient to all investors always. However, it is very possible that a given market (for example the New York Stock Exchange) will be efficient with regards to an average investor. The p ossibilities and the impossibilities also extend to certain markets as well as to different investors. This is because tax rates are different in different markets scenarios, and so are the costs of business transactions, which confer competitive advantages on certain investors relative to others. In essence, no group of investors can consistently utilize a common investment strategy and emerge victorious. There has to be variations with elements of lose to one or two
